1. Acceptance of Terms

By accessing or using Phrasium ("the Service"), operated by Phrasium ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.

Our collection and processing of personal information in connection with the Service is described in our Privacy Policy.

2. Eligibility

**THE SERVICE IS NOT AVAILABLE TO PERSONS UNDER THE AGE OF 18.**

By accessing or using the Service, you represent and warrant that you are at least 18 years of age and have the full right, power, and authority to enter into these Terms. If you are under 18, you are prohibited from using the Service. Any account created by a person under 18 will be terminated immediately upon discovery.

3. Description of Service

Phrasium is an AI-powered language learning platform that provides tools such as chatbots and exercise generators. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

4. User Accounts

Registration: You must provide accurate and complete information when creating an account.
Security: You are responsible for maintaining the confidentiality of your login credentials. You are fully responsible for all activities that occur under your account.
Termination: We reserve the right to suspend or terminate your account if you violate these Terms, including providing false age information.

5. Subscriptions and Payments

5.1. Merchant of Record

Our order process is conducted by our online reseller Polar. Polar is the Merchant of Record for all our orders. All billing, invoicing, and tax handling are managed by Polar in accordance with their Terms of Service.

5.2. Free Trials

We may offer a 3-day free trial for eligible yearly subscription plans. Free trials provide full access to the Service's premium features for the specified trial duration.

Automatic Conversion: Unless you cancel before the end of the 3-day trial period, your trial will automatically convert into a paid yearly subscription, and your designated payment method will be charged the full yearly subscription fee.
Cancellation During Trial: You may cancel your free trial at any time during the 3-day period via your account settings. If you cancel prior to the trial expiration, you will not be charged.
Eligibility: Free trials are limited to one per user, account, or payment method. We reserve the right to determine eligibility and revoke trial access if abuse or fraudulent creation of multiple accounts is detected.

5.3. Billing & Cancellation

Subscriptions are billed in advance on a recurring basis. You may cancel your subscription at any time through your account settings. If you cancel an active paid subscription, access to premium features will continue until the end of the current billing period. All refunds are subject to our Refund Policy.

6. User Content and AI Usage

Ownership: You retain ownership of any text, files, or media you upload ("User Content").
License: By uploading content, you grant us a license to use, process, and store this content solely for the purpose of providing the Service.
AI Output Disclaimer: The Service uses Artificial Intelligence (OpenAI) to generate responses. We do not guarantee the accuracy, reliability, or suitability of AI-generated content. You acknowledge that AI output may contain errors ("hallucinations") and should not be relied upon for professional advice.

7. Acceptable Use

You agree not to use the Service to:

Upload content that is illegal, harmful, threatening, or offensive.
Violate any applicable laws or regulations.
Attempt to reverse engineer, decompile, or extract the source code of the software.
Use the Service if you are under 18 years of age.
Engage in Not Safe For Work (NSFW), sexually explicit, or highly inappropriate conversations with our AI characters. We actively monitor for such usage, and detection will result in immediate account termination without a refund.
Share your account credentials with others.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Phrasium shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Turkey, Ankara.
